Welcome to the online learning platform for digiSTORY KC, hosted via Thinkific. By accessing or using our website, purchasing our courses (including but not limited to our Stop-Motion Animation Masterclass), or participating in our programs, you agree to comply with and be bound by the following Terms of Service ("Terms"). Please read them carefully.
If you do not agree to these Terms, you may not access or use this site or our services.
1. About Our Services
The Digital Storytelling Center of Kansas City (digiSTORY KC) is a 501(c)(3) non-profit organization. We provide workshops, online courses, and educational resources designed to advance digital media literacy and skills. Our online educational materials are delivered via Thinkific Labs Inc. ("Thinkific"), which provides the underlying learning management platform.
2. Eligibility and Accounts
- Age Requirements: Our courses are designed for students of varying ages (including grades 4–12). If you are under the age of 18, you may only use this platform with the involvement, consent, and supervision of a parent or legal guardian. (See our Privacy Policy).
- Account Responsibility: When you create an account, you agree to provide accurate and complete information. You are entirely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
- Account Sharing: Sharing account login credentials with individuals outside of your immediate household or authorized educational group is strictly prohibited.
3. Fees and Refunds
- Pricing: All prices for courses (e.g., individual student or teacher editions) are listed in U.S. Dollars and are subject to change.
- Refund Policy: Because our products are digital and delivered immediately upon purchase, all sales are generally final. However, if you experience technical issues or are deeply unsatisfied, please contact us at [email protected] within 14 days of purchase to request a review for a potential refund or credit.
4. Intellectual Property Rights
- Our Content: All materials provided on this platform—including videos, lessons, text, graphics, animations, curriculum guides, and code—are the intellectual property of digiSTORY KC or its licensors.
- Limited License: When you purchase or enroll in a course, digiSTORY KC grants you a limited, non-exclusive, non-transferable license to access and view the materials for your personal, non-commercial educational use (or classroom use, if you purchased a "Teacher's Edition").
- Prohibitions: You may not record, copy, reproduce, redistribute, modify, or sell any content from digiSTORY KC without our express, prior written consent.
5. User-Generated Content
Our digital storytelling courses may allow you or your students to upload or submit original media, such as stop-motion animations, scripts, or character designs ("User Content").
- Ownership: You retain ownership of any intellectual property rights that you hold in that User Content.
- License to digiSTORY KC: By submitting User Content to our platform, you grant digiSTORY KC a worldwide, non-exclusive, royalty-free license to host, store, and display your work strictly for educational, review, or course-participation purposes. We will never market or sell your creative work without separate, explicit written permission.
- Appropriate Content: You agree not to upload any content that is unlawful, defamatory, obscene, infringing on someone else's copyright, or otherwise harmful.
6. Third-Party Platform (Thinkific)
Your account is hosted on Thinkific's platform. Your use of the platform is also subject to Thinkific’s own Terms of Service and Privacy Policy. digiSTORY KC is not responsible for any platform downtime, technical glitches, or data practices controlled entirely by Thinkific.
7. Limitation of Liability
To the maximum extent permitted by law, digiSTORY KC, its directors, employees, and volunteers shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of—or inability to use—this platform or its educational content. Our courses are provided on an "as-is" and "as-available" basis without warranties of any kind.
8. Termination
We reserve the right to suspend or terminate your account and access to our courses, without a refund, if you violate these Terms, engage in disruptive behavior in course forums, or infringe upon our intellectual property rights.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any legal action arising out of these Terms must be filed in the state or federal courts located in Kansas City, Missouri.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our programming or legal obligations. We will notify you of any major changes by updating the "Last Updated" date at the top of this page. Your continued use of the platform after changes are posted constitutes acceptance of the new Terms.
